1. About these terms
These Terms govern your use of Trend Oracle ("the Service"), operated by ArcMedium.io ("we", "us"). By creating an account or subscribing, you agree to these terms.
2. The Service
Trend Oracle aggregates publicly visible TikTok trending data from TikTok's Creative Center and presents it with predictive analytics, AI-generated explanations, and brand-application suggestions. We are not affiliated with TikTok or ByteDance Ltd. Data freshness, accuracy of predictions, and AI-generated content are provided "as is" without warranty of merchantability or fitness for a particular purpose.
3. Subscriptions and billing
Trend Oracle is a paid subscription service. Plans are billed monthly or annually in advance via Stripe. There is no free trial. You may cancel any time through the Stripe Customer Portal accessible from your account settings — cancellations take effect at the end of the current billing period and your subscription will not renew. Annual subscribers are eligible for prorated refunds at our sole discretion.
Pricing is shown on the pricing page in EUR. Prices may change with at least 30 days notice; existing subscribers are billed at their original price until the next renewal.
4. Acceptable use
You agree not to:
- resell, redistribute, or sublicense the Service or its data without written consent;
- scrape, mirror, or programmatically replicate the Service to build a competing product;
- share login credentials between users (each seat is per-person);
- use the Service for unlawful, harmful, or fraudulent activity.
Violations may result in account suspension without refund.
5. Intellectual property
You retain ownership of any content you upload. We retain ownership of the Service, its software, design, and aggregated trend data. AI-generated content (brand applications, rewrites) is provided to you under a non-exclusive license to use within client work and internal materials. TikTok content remains the property of respective creators and TikTok.
6. Liability
To the maximum extent permitted by law, ArcMedium.io is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the preceding three months.
7. Termination
You may cancel any time via the Stripe Customer Portal. We may terminate accounts that violate these terms; subscription fees are non-refundable in cases of termination for cause.
8. Changes
We may update these terms with at least 14 days notice via email or in-app notification. Continued use after the effective date means you accept the changes.
9. Governing law
These terms are governed by the laws of the Netherlands. Disputes will be resolved in the courts of Amsterdam.
